Overview
Maine legalized recreational cannabis in 2016 (Question 1). Me. Rev. Stat. tit. 28-B, § 112 provides that employers may not refuse to employ or otherwise penalize a person 21 or older who uses recreational marijuana outside of work — provided the employer does not have a written policy prohibiting such use, approved by the Maine Department of Labor.

Maine Cannabis Context
Maine was the first state in the country to enact off-duty recreational cannabis use protections, effective February 1, 2018, less than two years after voters approved Question 1 to legalize recreational cannabis. Me. Rev. Stat. tit. 28-B, § 112 prohibits employers from refusing to employ or otherwise penalizing a person 21 or older who uses recreational marijuana outside of work, unless the employer has a written policy prohibiting such use that has been approved by the Maine Department of Labor. This requirement creates meaningful administrative friction that has discouraged some employers from adopting cannabis testing policies entirely.
Maine's caregiver model for medical cannabis was also influential. Before recreational legalization, Maine's medical program allowed individual caregivers to grow for and serve a small number of patients, creating one of the most decentralized medical cannabis distribution networks in the country. After recreational legalization, the caregiver model continued in modified form. Total cannabis sales (medical plus recreational) in Maine are substantial relative to population.
Maine's economy includes significant fishing, lobstering, paper and forest products, healthcare, and tourism. Federal contractor employment is less dominant than in some other states but still significant in shipbuilding (Bath Iron Works) and healthcare. The Maine Department of Labor approval requirement for employer drug testing policies is unique — it forces employers to formally engage with the state before they can subject workers to cannabis testing. For Maine workers, this creates a genuinely meaningful protection that many other states' workers lack. The combination of off-duty protections, the written policy requirement, and the caregiver-rooted cannabis culture makes Maine one of the most worker-protective states in the country for cannabis use.
What This Means for You
Maine is one of the strong-protection states. Private employers in most positions cannot take adverse action against you based on off-duty cannabis use or a positive test for nonpsychoactive metabolites alone. However:
